Fox gets smacked down in their trademark infringement claim against Al Franken for his new book's subtitle, "A Fair and Balanced Look at the Right."

U.S. District Court Judge Denny Chin called Fox's suit "wholly without merit, both factually and legally."

Yep, Fox News whines and whines about frivolous lawsuits and lawsuits supposedly driving up the price of products and services, particularly medical malpractice insurance recently. Yet they file this frivolous lawsuit, not grounded in law or a good-faith extension of current law, and fill their complaint with cheap shots at Franken not germane to the case.

If there ever was a case that was a candidate for Rule 11 (sanctions for filing a frivolous pleading), this is it. Franken is laughing all the way to the bank, as his book is already #1 at Amazon.com from the pre-orders. (It comes out Sept. 22.)
